Terms of use for the Horex website and services

1. Acceptance of terms

By accessing or using the Horex website, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the website.

Horex is a web design brand/project operated by Patrick Horenec. It is not currently registered as a company or craft/business entity and does not represent itself as a registered legal entity.

2. Use of the website

You may use the website for lawful purposes only. You agree not to use the website in any way that could damage, disable, or impair the site or interfere with any other party's use of the website.

3. Web design services

Horex provides web design, development, and related digital services. Specific services, deliverables, timelines, pricing, and payment terms are agreed individually with each client before work begins, typically as part of a written proposal or project agreement.

4. Project inquiries

Submitting a project inquiry through the website does not create a binding contract. Horex will review the inquiry and may respond with questions, a proposal, or a quotation. Horex reserves the right to decline any project.

5. Communication

By contacting Horex, you consent to receive communications from us related to your inquiry or project. We may communicate by email or through the client portal.

6. Proposals and quotations

Any proposal or quotation provided by Horex is valid for the period stated in the document or, if not stated, for 14 days. Prices shown on the website are indicative and are not automatically binding unless confirmed in writing. Acceptance of a proposal must be confirmed in writing by both parties before work begins.

7. Project scope

The scope of work is defined in the agreed proposal or project agreement. Work outside the agreed scope may be subject to additional charges and timeline adjustments.

8. Revisions

The number of revision rounds and the revision process will be set out in the project proposal. Additional revisions beyond the agreed number may incur extra fees.

9. Timelines

Project timelines are estimates based on the information available at the start of the project. Timelines may change due to client feedback delays, scope changes, or other factors outside Horex's control.

10. Client responsibilities

The client agrees to provide timely access to necessary information, content, feedback, and approvals. The client is responsible for ensuring that any content, images, branding materials, or other information supplied to Horex are accurate, legally owned or licensed, and do not infringe third-party rights. Delays in providing required materials may affect the project timeline.

11. Payments

Payment terms, including deposits, milestones, and final payments, are agreed individually for each project and specified in the project proposal or agreement. Horex does not apply a fixed payment or refund policy unless explicitly agreed with the client.

12. Cancellations and refunds

Cancellation and refund conditions are agreed individually before or during the project. Any agreed advance payment, cancellation terms, milestones, or refund conditions will be specified in the project agreement or quote.

Mandatory consumer rights under applicable Croatian and EU law remain unaffected. Nothing in these terms overrides statutory rights that cannot be excluded by contract.

13. Intellectual property

Horex retains ownership of any pre-existing materials, tools, and methodologies used in delivering services. Ownership and transfer of final project assets are agreed as part of the project proposal or contract, typically upon full payment.

14. Third-party services

Horex may use third-party services, tools, or platforms as part of a project or to operate the website. Horex is not responsible for the availability, performance, or terms of those third-party services.

15. Limitation of liability

To the extent permitted by law, Horex's liability is limited to the amount paid by the client for the specific services giving rise to the claim. Horex is not liable for indirect, consequential, or incidental damages.

16. Termination

Either party may terminate a project in accordance with the terms set out in the project agreement. Horex may suspend or terminate access to the website or client portal for violations of these terms.

17. Account and client portal usage

Clients with portal access are responsible for maintaining the confidentiality of their login credentials and for all activity under their account. Accounts may not be shared.

18. Prohibited use

Users may not attempt to gain unauthorised access to the website, client portal, or related systems, distribute malware, scrape content, or use the website for fraudulent or illegal purposes.

19. Changes to terms

Horex may update these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of the website constitutes acceptance of the revised terms.

20. Applicable law

These Terms are governed by the laws of the Republic of Croatia, to the extent permitted by applicable law. Any disputes will be resolved in the courts of that jurisdiction.

21. Consumer rights

Mandatory consumer rights under applicable Croatian and EU law remain unaffected. Where a specific consumer situation requires special treatment, the applicable legal provisions shall apply.
